Dear Sir / Madam My H1b Visa Stamped in the Passport expires on Mar 30 2010 but I-797 petition is valid till October 2010. So is there a possibility of going for re-stamping to extend the visa to say till the date the I-797 is valid? Any info regarding the above is much appreciated. Best Regards Ak

Hi, I am, a Canadian citizen, temporarily working from home in Canada for a US based company with H1B visa now. Although, it is correct that the H1b/H2b VISA is for work to be performed in the US as stated on the employerÂ’s Labor Condition Application (LCA). The work must be in the US. There is no such thing as bench when you are in H1B. If you go on unpaid leave without pay slips, then you will loose your H1B status. USCIS doesn't entertain people taking vacations without pay when you are in work visa.
