Does anyone else have a problem with the way Amex reports? I'm profiling an 8-thread OpenMP process on Clovertown (2 socket Xeon X5365) to analyze poor scaling. I'm seeing similar CPU utilization. Anywhere between 20-50% on average with a relatively large number of tabs open (~15). I uninstalled or disabled all of my add-ons, and the best I've seen so far is idling at 6-9% with one browser window open. Kernel_task is a main under-lying process for your OS X, so it might show a lot of CPU use, and is quite normal. I wonder about the AppDaemonUSB... What do you have plugged into your USB ports, other than mouse and keyboard? Do you have a USB wireless adapter? If not, do you have an external USB hub? Try disconnecting that hub or USB wireless, and then check your activity monitor....

Your point is interesting. I think it is just hair-splitting. Taken in the overall context of the way order of preference by this country of the GC allotment, EB1>EB2>EB3 (just the order of priority). So, it would make sense that unused EB1 would flow to EB2 and then to EB3. Further, I do not know if the numbers trickle down from 4&5 to 1 and then 2 and 3 also. I know that 1 goes to 2 and 3....
