Jim, The ITC decision is all about claims language. Nokia was successful in limiting the claims in IDCC selected patents so narrow, that the patents don't apply to any technology. That is what IDCC is appealing. Finally, we agree. A new ITC case against Nokia would be good news indeed. We have the cash, lets use it. However, I am really pissed we are bumping up on the deadline to file an appeal. What the hell is taking so long? Merritt even mentioned it would not be that difficult to file the appeal (or costly) in the last CC. All they are doing in my mind is wasting another 2 months...

Net presently there is no current ITC case, that was over with the full commissions decision back on October 16th. With that ruling the ball was put into IDCC's court to file with the appeals court or drop the ITC matter fully. Personally I expect an appeal to be filed with a very strong basis of law and claims construction clarity to have the ITC decision of no infringement reversed. That's my ...

ITC I'm wondering the same thing what Mr.Bravo is doing... I don't understand what he's doing... If sales really are doing well on re-juv he should have plenty of money for pr's and pinksheets.com filings and such... Something does not add up here at CXAC... I dont care what anyone tells me different... Were weeks behind things here at CXAC.

The IT Commission does over-rule its judges' findings of non infringement and other rulings frequently. They did recently with Tessera and I expect them to overrule in that case again soon.
