I recently received the H1-B approval notice (Form I-797A) filed by company A for me, which has the validity from may 2010 to may 2013. Also, I have my OPT card valid till oct 2010. The issue is, I want to move to another company B before may 2010. Did that H1B come with a new I-94 attached to it? If Yes, then your status is H1B starting Oct 1st 2009. Your employment in OPT status after Oct 1st is illegal and you are out of status if you don't have pay slips from the H1B employer.

I just read the following in an USCIS memo. Does this mean that one can be out of status without pay stubs etc and still file for an extension provided his labor is pending or I-140 approved.
