Hi there, I'm seeking some advice for my husband who faces a disciplinary hearing today in his work in relation to gross misconduct. He has worked for this well known bank for 5 years now and has an unblemished record. I would even go as far to say that he is extremely well thought of. Ok the background of the hearing is this: back in July a colleague of my husband's sent on a forwarded...

Hi, My meeting today to discuss a compromise agreement didn't go ahead as planned, instead I was suspended without pay pending an investigation into Gross Misconduct due to forwarding company emails to a private email address, slightly worse actually a temporary company address setup prior to incorporation and owning the domain name for my new venture. There was a list of around 15 emails....

My friend has been suspended due to internet abuse. Downloading of illicit things, porn, videos etc. MP3 tunes. Some has gone back years, lately though it has had really bad things downloaded to this internet account. Although when we have checked my 'friend' hasnt always been there. Does this throw any doubt over the claims? Does this show someone else must have access to their ...

Hi all, yesterday i was suspended from work, pending an investigation. The investigation is in reference to a website i have set up. I work for a finance company offering mortgages, iva's debt managements and insurance. The website i set up was designed to generate leads for life insurance by having a link to a price comparison website. My employer is claiming this is a disciplinary issue...

Hi to all. Please help. My son works for Netto (2 years service) and recently his manager found out that he has been offered a job elsewhere and was not happy. My son did not give his notice in at this time as he was waiting for a start date from his new employer. In the mean time his manager at Netto saw him not charging a customer for a carrier bag. His manager then reviewed cctv footage ...

A couple of questions related to COBRA's gross misconduct exception which I've seen discussed some in general on the board but have not been able to find definitive answers. 1. Realizing the lack of a clear definition of "gross misconduct" for COBRA purposes and other risks associated with denying COBRA coverage, assume a plan sponsor is determined not to provide COBRA and has ...

I think the fact that you went to your employers to confess this, and werent caught out has to go in your favour. If you hadnt been honest they would still be none the wiser. As already advised, write everything down so that you dont get upset and forget everything you meant to say. You cant take it back, but you can walk away from this with a clear conscience that you did everything you ...

I think your problem might be that although you have not yet contacted any of the suppliers/clients mentioned in the confidential emails which were the property of your employer, which you forwarded to an unauthorised email address for unauthorised use, considering you were setting up a similar business at that time you could never prove that you were never going to use this information, or that ...
