Since the payments must be disclosed as montly on the GFE and HUD Loan Terms - how are banks handling the customer's request for quarterly payments? Would the GFE and HUD list amounts for monthly payments and then the Note and early and final TILs would list the quarterly payments?

It isn't a substantive change if your provide a gfe with out the vital info. So if you provide a gfe based on zillow and the credit score is lower my understanding is that it cannot be revised because you shouldn't have done. it. The simple solution would be that Zillow change request a good faith estimate to request a fee summary and we are all good.

What does state law say regarding transfer taxes? Who is responsible (has to pay) the mortgage tax and the doc stamps on the deed? We operate with the understanding that the buyer pays for the mortgage tax and the seller pays for the doc stamps for the deed.

Also please remember that as of 01/01/10 a GFE will most likely only be provided after you have a signed loan application and a contract. My total fees between front and back is normally 1.8% I discount my origination fee to reduce cash to close, which is normally one of the issues with my clients. I also offer to show my clients my rate sheet and teach them how to use it.

David - the question you answered was referring to a refinance of a purchase. To confirm, on a purchase we would be required to show an estimate for Owner's Title insurance even if the bank did not require it, is that correct? HUD's response: Quote: In the case presented this is a borrower requested change which constitutes a change circumstance. You would issue a revise GFE using the old form since the original inception date of the application and disclosure was in 2009 and you did not originally disclose using the new GFE.
