Thread: need legal help

Long story, involving prior daycare giving out private (emergency contact) information in an attempt to collect un-owed funds..  need to know if this is legal... anyone have a legal mind???

Nancy, my SIL is a lawyer and I could ask if you like....but I also know that Meredith (ourherione) is also a lawyer. I have no idea...sounds wrong to me....but don't know about the legality of it!!

Do you have statewide daycare certification? I don't know about the legality...but I do know that if they gave out personal information to attempt to collect on moneys that were NOT owed to them then I would report them to a local licensing agency ( we have PATCH out here in Hawaii)

Is the original creditor coming after you, or have they engaged a debt collection agency?  If it is a debt collection agency, they are bound by the Federal Fair Debt Collection Act, which prohibits them from contacting any third party (with the exception of your attorney) for anything other than to determine your whereabouts.  They can also contact your spouse or any co-debtor on the account. ...

Thanks, Meredith.  I appreciate you taking the time to share that info with me! The story is:  we pulled our kids out quickly when our concerns about staffing were not handled, and ultimately one of the employees was arrested for exposing himself to a minor.  They continue to hound us for the pay for 2 weeks notice; which we did not give.  We did pay for every hour our kids were in their ...

I just want to say good on you for listening to your gut and getting your kids out of there! They should be worried about your suing them for not addressing an obvious problem. Chances are this wasn't the first time the person did something inappropriate.

I would think that if you detail your story like the first one, the next attorney might also bow out. I don't know the law for your state, however, I do think that when something criminal (child pedofile) crosses into a civil situation, the rules can change and change fast to be in favor of the party who opted to make sure the child was being protected. Nancy, if this drags out and you do end up needing representation, let me know. MIL is a judge in DE and practiced with one of the biggest firms in Wilmington. I can get her to place a few calls for you if necessary.
