My daughters boyfriend got a probation violation, and he is to serve 1 yr ksmr, and the second year probated. They are classifing him and it says his serve out date is Sept 2010, How can that be, he has been in jail since august 7th, he was sentenced the 18th of sept, the judge said he would get credit for time served (had 42 days served when he went to court for sentencing), Im confused how the ...

I'm not much help on the time thing....I stay so confused! Perhaps the Sept. 2010 date is his max and doesn't include any good time?? Then again, perhaps they've got it wrong.....its been known to happen. the sept date is his max out date. he needs to keep up with his time served and his good time and his work time they are subtracted from his max out date. it is something he needs to keep up with to make sure he does not do more then he should.

Thanks for the replies, He has already done his shock papers, had to send them off somewhere but he has already done that so i am watching the court website to see when he will be on the docket, he will probably know before I do but I want to try to help all I can. I hate his public defender, he will not return his mothers calls, is there anybody we can contact to get him to answer her calls, ...

I just wanted to update you, he done his shock papers right but unfortunately he got denied, he is going to try again when he is allowed, His lawyer told his mother he would be going up for regular parole in a month or so because he has his 15% served. Man I will be glad when that kid gets out of there. thanks for all the replies, I will keep you posted. thanks jackie

I'm sorry he didn't get the shock, perhaps he'll get the parole next month. Fingers crossed for ya! LE can railroad anybody they damn well want to whether they're a parolee or not....that's a sad statement about our injustice system. In their defense, PD's are excessively overworked...but how long does it take to pick up the phone and call a client's mom/family member? Best of luck with ...

I just wanted to update you, he done his shock papers right but unfortunately he got denied, he is going to try again when he is allowed, His lawyer told his mother he would be going up for regular parole in a month or so because he has his 15% served. I'm sorry he didn't get the shock, perhaps he'll get the parole next month. Fingers crossed for ya!
