It appears that this needs a server restart Windows server start for every time the application is updated which is not really acceptable, any suggestions?

There are any feasible way to resolve this since the application server loads the reference for the class inmemory from the dll and the second load is basically trying to use the same memory space already occupied. To resolve this, the programming team will have to rearrange the process of loading referebce to dll's during application server startup.
