First of all I want to say that I wear my seatbelt, normally. I don't have any small children, and if I did they would be buckled too. But as you may know, and I know that we are all guilty of it, sometimes when we have other things on our minds we forget to put our seatbelt on, especially just running from store to store doing errands. I actually heard this on the radio the other day - police CANNOT pull you over just for not wearing your seat belt and give you a ticket. I believe the officer was in error when he pulled Steve solely for failing to buckle up. The seat belt law remains a secondary law in SC unless I'm mistaken; that is to say, the motorist must first be pulled for another reason, then the seat belt laws applies during the course of the officer addressing the primary law violation, i.e. speeding, careless driving, etc. By all means, Steve ...

No one in the vehicle was under the age of 17. I was driving by myself. I was not driving erraticly, nor was I speeding. I saw the Police Office sitting on Otranto Rd. near a convience store, he was parked and monitoring people as they were driving by, a few seconds later he was on my tail. Do your civic duty and contest your citation in court. Heck, ask for a jury trial and defend yourself in court. Chances are your charge will be dismissed simply because the court doesn't want to "waste its time." More people need to challenge traffic violations in court.

As you've probably heard by now, the primary seatbelt law has passed committee and will be sent to the legislature for debate and a vote. I think wearing your seatbelt is the right thing to do. I'm just not happy about this law. It will be impossible to enforce and it's your word against the police officers' when your in court. I don't think it's being done in the interest of public safety. Jamie, most traffic tickets come down to one's word against the other, so seat belt law enforcement won't be anything new. I am not sure where I stand personally on belts, but on the Law side it will certainly clear up a longstanding double standard that the legislature placed on the enforcement of the law... what other law can you think of that was passed and cops were told not to enforce "X" unless "A" was also...

Personally, I think that wearing a seatbelt is a great idea and it does save lives- and I do it. However, do we really need the Gov't telling us to do so, and actually forcing us (by threatening us with a fine, ticket, etc...) to do it?
