I actually heard this on the radio the other day - police CANNOT pull you over just for not wearing your seat belt and give you a ticket. I believe the officer was in error when he pulled Steve solely for failing to buckle up. The seat belt law remains a secondary law in SC unless I'm mistaken; that is to say, the motorist must first be pulled for another reason, then the seat belt laws applies during the course of the officer addressing the primary law violation, i.e. speeding, careless driving, etc.

Do your civic duty and contest your citation in court. Heck, ask for a jury trial and defend yourself in court. Chances are your charge will be dismissed simply because the court doesn't want to "waste its time." More people need to challenge traffic violations in court.

Jamie, most traffic tickets come down to one's word against the other, so seat belt law enforcement won't be anything new.
