I can understand that, actually. Suppose our military was chasing an enemy bomber, and that bomber crosses into American airspace. Are we supposed to get a court order to shoot that bomber down? No fucking way.

The 4th Amendment "has no application" because the Posse Comitatus Act from 1878 should keep the feds from using troops as police internally. The previous adminitration's view was "the War on Terra trumps that law, so why wouldn't it also trump the Constitution?" The article seems to say the new administration is reversing this policy. (You did read the article before you commented, didn't you, folks?)
