Blizzard specifically states that any account that you did not pay for - even if it is your own brother or sister's account is considered not a legal account.
I too had such an account that my brother gave me - but when I saw that this was against the rules I decided for the sake of integrity only to use the account that I paid for.
It is not a legality issue but it is against their ToS. It doesn't really matter who paid for it. You can be given WoW as a gift. But according to the ToS you are to be the original owner of any account you play.
I am certainly not an expert on law - but I always thought that anything that violates the ToS would be legal issue since it is legally binding to accept the ToS
I posted in the other thread... I say take the 80's and make another character on that account since you never got past 20 in the first place.
Also, as far as th ToS goes... more knowledgeable people than I have told me that the ToS' main purpose is to protect the company in legal binds.

To answer your original question (rules aside) I would say to use the account that has the 80's on it. I would suggest if you do that though not to begin by playing those high level characters because you will feel lost and because people will think of you as an awful player. Yeah, I'd play the account with the lvl 80s in it. Try out the lvl 80s and see if u like them. Do some research and learn how to play them and try them out in some easy dungeons.
