Thread: Giving notice to my landlord

Started 1 month, 3 weeks ago by starlight_xx
I rented my current flat from a former friend. She then sold the flat to her mum who took over. Some time ago her mum decided to sell the flat but hasnt actually made any great moves to do so. Since she decided to sell she hasnt renewed my lease, so we have an informal arrangement. Im now planning on moving out, am I obliged to give her any notice??

How would you feel if your landlady turned up tomorrow and asked you to start packing, you'd expect fair notice right? Are you sure you aren't in a rolling monthly contract?

starlight_xx replied 1 month, 3 weeks ago
No Im on no contract what so ever. I have NO contact with her, anything thats gone wrong with the flat Ive been left to sort out. So long as the rent goes in every month shes no interest in the place. Im not planning on moving out at the end of the week but Im going to view some other flats this week. If I have to pay rent on this flat for a month or so its not a great problem.

What kind of lease was this which was not renewed? Do you still have a copy of it to hand?

1 months notice is usually considered fair, given from rent date.

It was just a standard 6 month contract, Ive been here for 9 years, no lease for about the last 2

Just because it is not written down does not mean there is no contract. a) If there WAS initially a written contract with your original friend, then assuming this has expired (ie the 6 or 12 month term or whatever is up) then you have a periodic tenancy. b) if there ...

If you pay rent monthly you are on a statuary periodic tenancy with a period of one month. You need to give one months notice ending at the end of a period. Take the start date of a period as the date you moved in. For example move in on the 5th give notice of a least a month to move on on the 4th. As you had a contract originally, that would likely have been an assured short hold tenancy ...
