Thread: Dispute over a hedge

My mum had a hedge at the end of her garden since she moved into her house (over 40 years ago). Some neighbours moved into the house behind her about 20 years ago, and have continually complained about the hedge - they have gone to court claiming it's their land, and they want to dig the hedge up (they lost). They have asked my mum to remove the hedge as they don't like ...

Your poor mum! That is so upsetting... Can you prove it was the neighbours? I would get some kind of legal advice here.. especially as the court has ruled in a previous case that the hedge is not theirs to touch.. Hope you manage to sort it out.

If it was the neighbours, your mum would have a good case to sue their arses. Like you say, the hedge was there when they moved in, and they have lost two court cases. I dred to think of the wildlife they have killed that was living in that hedge if its been there THAT long. I would contact the Citizens Advice Bureau, and ask them what you can do.

No advice but just wanted to sympathise with your Mum. Some people are so selfish. And who in their right minds would prefer a crappy fence to a lovely mature hedge? Idiots!

Well this a question for the lawyers here but I imagine on a commonsense basis they could potentially be in trouble since they appear to have acted against court judgements, ie the dispute would be primarily with the courts and not your mum. But then again as I said, I know diddly-squat about law.

@ Bandersist - No, we have no proof it was them, but I can't imagine it being anyone else....I think they thought that because she's a pensioner, she wouldn't stand up to them - wrong ! She has 4 very annoyed daughters! And thanks for everyone else's comments - we are going to threaten them with Leylandii tonight, unless they sort it out to Mum's satistaction....

Sue their asses..... who else would it be...???? My firend had a similar instance over a wall - ugly but serviable, new neighbours complained about it (as it was my mate's responsibility for upkeep) but even after having the council to declare it unsafe they were told no it was servicable and not a danger. ... lo and behold a week later she came home to find the ...

The fact this matter has previously gone to court the neighbours are probably now in contempt of court for removing the hedge. I can't really believe that it was anyone else who did it, can you? Suggest you obtain legal advice.

No advice, but your Mum has my sympathies. My neighbour cut down two of our trees while we were out for dinner once.

The now cut down hedge which was once covering up your mums unruly shrubs. That will teach them to take advantage of an elderly lady. Karma.

I will say I don't advocate digging up their flowers, but if it has been proven in court that it was your mum's hedge, by the same token, it's now her fence So the fence is fair game! (at least that's how I'd argue it!)

Some people really deserve to be taken up into space and dumped on the moon. Excellent suggestions so far by the way. One thing that I haven't seen suggested so far is the RICS free advice helpline. If your Mum visits CAB, they MIGHT refer you to RICS (Royal Institute of Chartered Surveyors) as they offer free 30 minutes advice from a local chartered surveyor - specifically for things including neighbour/boundary disputes.
