It's a "states issue". Just as some states that can keep it out of the ballot box altogether benefits one group, a constitution like this one, and California for that matter, is much more "the people" oriented.
But, what people will say -- "Civil rights should not be put up for a popular vote anyway."
Which is true. But, does it hold true with this issue because... is marriage a civil right?

This is a stupid argument to be constantly having since the Constitution is quite clear in the 14th amendment that we are all equals and have the same rights as one another.
