My brother has had to file for bankruptcy (personally and his company). I am now receiving calls from debt collectors trying to get in touch with him. Questions: 1) I assume that I have no obligation to tell these people how to find him. 2) Do I have any recourse to make them stop contacting me?
Have your brother contact them and tell them he filed for BK and then that will be that, they will stop calling both of you. [Sometimes I sits and thinks...sometimes I just sits...]
Unfortunately my brothers small business failed and it took him down personally too. He's filed BK for both the business and personal to be able to keep his house. He's selling off everything he can to raise as much money as he can to pay his debts as much as possible. As much as I hate BKs, hes at least trying to pay off all he can, he just didn't want to lose the ...
The attorney should be willing to take these calls in that case. I see little reason for either of you to deal with this, why can't you simply give them the attorneys name and number and let him deal, that would seem to me to be part of the representation. Your brother needs to explain to him that you are being harrassed and it's not fair to you to be stuck in the...
In reply to: Exactly: the collectors get paid on a commission basis and they will not want to waste time on an uncollectible claim. Also, it's a breach of the "automatic stay", and a violation of both the FDCPA and the bankruptcy code.
Furthermore, I believe there is in effect a "treaty" between the Bar association and the-- whatever the name is--association of collectors, whereby a collector, once he knows a debtor is represented, may not contact him directly.
parties have been served as one of the creditors, and who knows if the attorneys has done this yet? Who here knows if this creditor made the list, people have forgotten and left off a creditor. Suppose this creditor is not on the list, it would be a good way to get them on the list, and it sounds like they have not, and that's why simply giving them the attorneys ...
Thanks 1C. I was jumping to conclusions that this creditor is trying to go around the proper channels. I will find out the name/number of my brothers attorney and give that out when they call so they can follow the appropriate steps. It just irritated us that they weren't trying to track him down. They just wanted to use us to pass a message to him. Personally, ...
It's a nightmare, been there, done that, people calling for someone else. But, they may not be aware, that's why I say, the onus is not on you, to keep putting up with this, it is on your brother's attorney to step up and say, refer them to me. In fact, that IS the way a decent attorney would do it, because as indicated PROVIDED they have notice then they ...
