I have a roommate that needs to be out of my apartment. Id rather not list the reasons. they paid to stay for the month, its the middle of the month. am i ab oleto kick them out without giving them 30 days notice and in the middle of the month without there being any legal problems. first/last months rent was not paid. no lease or anything was signed.

If they paid for the month and are not willing to move out until the end of the month no. You have to have 30 days notice.

I'd say if they are not on the lease kick them out. maybe give them the rest of the two weeks but if they did something really bad perhaps you should give them half the rent back and give em the boot

Depends on what state your in. I know in Minnesota if they are not on a lease and haven't paid first and last months rent than they can be give 24 hours notice. If its drugs your wanting them gone for or something else that's illegal go ahead and talk to you local police department or talk to a attorney or something and find out for sure what you can legally do so you are not in trouble or ...

you have to give him 30 days. even if you were to call the police they would say the same thing.. even if the roomate was living there for free you would still have to give them 30 days notice.. i would type up a paper and have them sign it as proof that you gave them 30 days..

If they aren't on the lease, show them the door. Especially if they are doing something to jeopardize your lease. Just tell them it isn't working out and you want them out at the end of the month, or if they are violating the law... invite your neighborhood cop up for a cup of coffee.

I could be wrong--but I think that you do legally have to give them a notice. If they are living there and you want them gone you cannot just kick them out with out notice, even if the person isn't paying rent. And even if there was no legal documentation signed. I would still check around and see though. The laws might be different where you live.

The only way you can get out of, I'm guessing, your verbal agreement is if there is danger to you or your child. Most courts would uphold that eviction. Also, your tenant is on a month to month. Unless you signed something that says you have to give notice, you are under no legal obligation to do so. I live in Ontario too Anyways as far as I know you have to give them the 30 days notice unless it's a really bad reason why you want to kick them out. i don't know about canada; but here, even if they aren't on the lease, aren't paying rent, etc., you still have to give them 30 days notice...if that is the case, perhaps send it through the mail as a certified letter or some way that gives you proof you gave them notice if they will not sign a letter stating they were given notice; and a witness to the whole affair doesn't hurt either....just ...
