Two recent cases show that companies aren't always fans of criticism, and some will file misguided DMCA notices and defamation cases to scrub it from the Internet. Read More

The corporate lobbyists who paid Congress to pass the DMCA, of course. Who else?

The system only works if the little guy actually has recourse. I feel a little uneasy that the little guy can fight these things until a precedent is established where the little guy countersues and is awarded some damages.

I hope the next group of leaders in D.C. will man-up and repeal all of the crap rules and regulations that have been created in the name of "copyright protection". Hell, I'm willing to bet that pretty soon committees for political candidates will start to play the take down game. As much as I liked Clinton as a president, I think his biggest mistake was signing the DMCA.

John W. Dozier, Jr., Esq., seems to wants us to think that all bad reviews are posted by competitors. I can't seem to find the reviews posted by happy customers, though. Maybe the competition filed a DMCA takedown on those. LOL

The bitter irony? The alleged cause of the DMCA complaint was apparently this image, which was attached to an exhibit in the lawsuit against the anonymous individual and "appears to be taken from the cover of a trade magazine." So even if the use of an image found in a court document isn't fair use, Public Citizen questions whether Powermark even owns the copyright to begin with. Yup. You can...

My parents used DirectBuy when they built their current home a couple years ago and had a very good experience using their service. They still shopped around, but often times they found that DirectBuy really did have the best prices, and the service that came with it was very good. (Subcontractors working for DirectBuy were much more likely to serve the customer well than other subcontractors who were more interested in big jobs with large...

This doesn't really require the DMCP, as long as the US justice system stays "everybody pays", free speech costs $250,000 (no DMCP needed). This would be a lot harder to pull off in the UK.

But on the other hand, UK libel laws lend themselves (the defendant has to prove the statement is true, rather than the plaintiff proving the statement is false. Look at the McDonald's case for an example) to abuse by well-heeled plaintiffs looking to silence critics.

Oligarchy Oligarchy (Greek Ὀλιγαρχία, Oligarkhía) is a form of government where political power effectively rests with a small elite segment of society (whether distinguished by wealth, family or military powers). The word oligarchy is from the Greek words for "few" (ὀλίγον óligon) and "rule" (ἄρχω arkho). In this case the elite few are the corporations. Here's a ten year old article that kinda...
