Any ACH authorization is open ended. The bank has no way of knowing if the dates are fixed or variable and the same with the amounts. This is NOT the banks fault. I know that nobody but me reads all those bank disclosures but it's in there. Now obviously the collection company is doing wrong but they don't give a crap. Try to prove exactly what was authorized ...

It certainly can be risky. I'm quite fussy who I will give that authority to. I'm okay with the people I bank with, like letting my bank auto draft a credit card payment, mtg payment and such. I also allow the IRS to auto draft my quarterly taxes and my Insurance company to auto draft premiums. But I would never allow that for something like a health club ...

Yes, under Florida law--and similar laws elsewhere--a spouse has a certain interest in the real property of the other spouse. Historically, it is known as "dower" or "curtesy". That is why foreclosure actions always include both spouses.

Don't ask us, do some research. What is fair marktet value of a 2/1 in your area? If it's above $42K you should be in great shape. Even though you've lived there, get an inspection. I'm a contractor and still have things in my own home that could slip past me if I didn't keep on top of things. If you want to move in 2 years will the current market support $42K?...
