Sufficiency of the Evidence
Published (2009-11-27 12:20:35)
Fine Line/Ambiguous Threat Death is unquestionably serious bodily injury. Someone's intent is normally inferred from his conduct. Jones demonstrates once again how difficult it can be to predict the sufficiency of the evidence. The verbal threat was legally sufficient to show guilt, but too ambiguous to truly justify the jury's conclusion. This seems way too close to the thirteenth juror test to me. Why not just say the inference of...

How could the medical evidence show that the victim would not have died from the first four bullets and the clubbing? Can an intervening set of circumstances negate your intent? THe jury didn't think so, and I would imagine the facts and pictures were pretty clear that the two did not intend for the clerk to live. If you shoot someone and they crawl into the street and get run over before ...

Ed started out at the Fort Worth PD Crime Lab in the 1970's. From there, he went to the Crime Lab at the Arizona Department of Public Safety. He was there a pretty good amount of time. I think he now teaches at the University of North Texas in Denton. He has published a book on reconstructing shooting scenes. I have not seen him in a while, but he used to be a very good witness.

I have used both of them before when giving advice or teaching classes for law enforcement officers. The publication is from TDCAA and I hope it is still available.

I'm familiar with the DPS bulletin. Isn't part of the problem that the info is coming from private companies rather than gov't agencies?

Getting closer
Supreme Court rejects appeal by death row inmate from Fort Worth BY JOHN MORITZ STAR-TELEGRAM STAFF WRITER The U.S. Supreme Court on Monday declined to take up the case of a Fort Worth killer whose lawyers said should be spared the death penalty because he was mentally retarded when he and an accomplice strangled a 65-year-old war veteran during a 1993 robbery. Footnote 5
A jury operates under the presumption of innocence. If the State convinces 12 (or 6) persons beyond a reasonable doubt, then it must still satisfy the highly skeptical, but reasonable reviewing judges that the State built a bridge (albeit with less than perfect pillars) that enable at least two of them to jump to the conclusion reached by the jury. Wait a second. DPS is supposed to be free for law enforcement testing. If they contracted with someone else, the certificate should be included within that contract. This smells like a feedlot to me.
