We have checked with Attorney and got the suggestion as, all enter to USA on L1 . So I postponed my wife's ticket to last week and I also i traveled to India. We entered USA this week with L1. So we are very much L1. My questions here. Yur current status is L-1B 1) As per H1b COS I was out of status for some months. Will this effect on my GC process? There is a posssiblity of checking the entire validity period of the alien status. Even...

I think a better idea would be for your spouse and you to get to the US and settle in, find your way around etc etc., and then invite your parents over. Otherwise, your parents can apply for a tourist visa, but independent of your "sponsorship" (since you've never been to the US, your sponsoring them wouldn't amount to much); have them apply showing their own bank balance, ties to home country, reasons for returning...

H1B ext denied

Technically you are out of status and will be accruing illegal stay since your extension is denied. My opinion is to leave the county immediately to avoid any complications in future. May be you can consult an attorney who can help you to decide.

Hello fariborz_rah, When you got your green card approved 9 months back: 1) Where did you stay (inside US or outside US)? 2) If outside US? Did you have valid AP? 3) If not a valid AP? When did you enter US (in-terms of days or months) after receiving your GC? 4) Did you face any trouble @ Port of Entry in US? Your response might give some clue to my situation (GC approved; AP expired; outside US). Thanks. Ram

Hi
I went to US ~2.5 yrs back and started working for a consulting company. I worked with them for ~1.5yrs and switched to a public company. They have sent me to India for 4 weeks for some official work. I thought its a good opportunity to get my H1-B visa re-stamped. I went to US consulate Delhi on 4th June 2009. The officer (lady) did ask me about my current and past work. She saw my I797 ...

the only way to save it is by actually living in the US.
If you stay out for 6 months, you have to prove that you did not abandon residence in the US. If more than 1 year, it is assumed abandoned.

your cousin can write a letter addressing it to USCIS stating that he is
ready to sponsor all your expenses while you study in US. He can get this
letter notrized, this may help.

Congrats on getting your H1 approved. To answer your question, recession is
officially over however, there are still no new jobs in the market. I would
say that you need to wait a little and be more patient. Try checking in by
the end of first quarter, next yr. Good luck

I am a US resident and will be visiting India in Nov End. I am trying to
book my visa Appointment in Delhi but VFS site is not allowing to book any
appointment. It is asking to check back in 24 hours. Is anybody else facing
same issue while booking appointment in New Delhi?

For COS from H1 to H4, you need to have the last 2-3 paystubs. With out these I assume the COS will not be approved. If she is on H1 she should be paid regularly by her employer irrespective of having a project or not.
I did see some postings where they said that if she is never employed then COS can be done and they had the approvals.
Please look at the following thread may be this helps...
