That should be legal since you were paid at least minimum wage for the training. (unless you have a binding employment contract or CBA guaranteeing a greater training rate than what you received)

If you want this conversation to continue, there will be no more of this: it may sound like that is what i meant who knows maybe i meant it but didnt say it or maybe i dont. you will never know unless you know me or i tell you. If you want help from us, we need realities, not maybes and not games. That is a game. Next time, I close the thread. Got it?

You mentioned "security company". You did not mention what your normal job duties are. I am going to assume for the sake of discussion that you are a non-exempt employee doing something like the work a security guard would do. If so, it is extremely likely that you must be paid (on average) at least minimum wage for any particular work week for all hours worked. The training time is almost certainly "hours...

Thanks again. I still really think that in my case I would not be considered outside sales. I only work 2 days per week, at my employer's showroom. This is where I present my designs to my client & make my sales. My employer is requiring me to spend a minimum of 2 days working in the showroom even though technically they are not directly paying me to be there. My pay comes from the commission based off of gross profit of the sales...

You have to seriously wonder about an employee who works with smoking cessation programs for a living who would voluntarily start smoking.

My understanding is you (exempt salaried employee) can be required to use vacation/pto for partial day absences of 4 hrs. or more per Conley court decision. (There is nothing in the CA-DLSE rules, opinions or court decisions that indicate that this "rule" affects reductions in sick pay.)
I also understand per some Ca. responders on this forum that it is assumed under 4 hrs. is not allowed ...

I am going to give you two different answers.
- From strictly a labor law situation, the employer is in a very weak situation to get you to give money back. They are in an impossible situation asking you to work for free, since that is illegal on it's face. If you were a bad employee, then their sole recourse was to fire you. The closest thing that they could try is to claim that your output ...

Under federal law (FLSA), auto sales people must be paid at least minimum wage for all hours worked, but do not need to be paid the overtime premium. I am fairly sure that OH follows this particular rules.

I can give you federal lunch rules. I have no idea what rules (if any) OH has on this subject. OH has a reputation for not having...

It is said the meek shall inherit the earth,
I don’t see that happening anytime soon.
Are you a member of what could be called a minority or “target” group? She could be charged with a hate crime for making terrorist threats, and the police would be on her like white on rice.
If not then after all is said and done, moving may be your only permanent solution….drr

Perrieka,
You probably would need to talk attorney to determine the legality. Just speculating, I would think that if both parties agree, that the agreement does not conflict with another existing contract or policy, and it's legal then I'd think you would be fine. If it were me I would have to have several additional conditions.
For example, I'd want the funds held in escrow until the...

I install windshield in cars, I'm mobile. The reason I asked about the vacation time is because I took 2 days vaca time and wasn't allowed to take the other 3 days because there wasn't enough work, so if i took those days off i would get docked pay. So being paid salary means I can do 40 + hours a week and not get paid ot? And if it is owed to me how can I prove it if theres never been any ...

Thanks PattyMD!
So it is your opinion that I should mention that I believe I was mis-classified as an Independent Contractor in my Appeal letter?
Just want to be sure I am understanding correctly. I am hoping to get the letter finished and drop it off today.
Thanks again for all of your advice! It is truly appreciated!

You have both Arkansas and California in your subject line. Based on your first paragraph, I'm assuming that you actually worked in California and my answers are predicated on that assumption. If that is wrong, please advise.
I don't know what an "exempt type of business" is either, except maybe they're talking about a business that is not subject to the FLSA or California labor laws. Let...
