I got my H1B extension (I797) without I94. Here is the story.
My employeer had filed my H1 extension on 15th Aug but my I94 got expired on 5th Aug before filing xtension. I got my reciept & I797 with extension but not I94. Also, just to clarify - there was a note written on my application before I went to the VO - it said - "PIMS not found" and when I asked what it meant, VFS folks said it is something for their administrative purpose. Not sure if that triggered any of the 221(g) related content.

You will need AP so that your 485 is not assumed to be abandoned.
No issues with H1 visa if job, employer, your qualifications are legit.

COS from H1B to H4 from within U.S is not possible since you are out of status. Also, you may face issues with your H4 stamping for being out of status.
There is no such thing as bench when you are in H1B. Irrespective of whether you are productive or not, the company need to pay you. If your employer hasn't revoked your H1B petition, then you should complain to DOL and make them pay to ...
