Whats the worst that can happen...

I am not so sure - people keep telling me they would like to come in and talk about things or have a phone call in the New Year. Creditors are more interested in getting people to take out credit at this point in the year methinks!! .... and someone has given me a selection box of PLAIN biscuits. Hang on - chocolate surely for Xmas!

Trace debtors to a new address...

Well, yes to an extent it is scary. But really, with the Internet and today's modern technology, I would think that is would not be all that difficult to track or trace someone if you really wanted to, WITHOUT paying that sort of money. But it also goes to show that despite the parasites we have in the form of DCAs, there are also other 'predators' out there that seem willing to assist in the murky business of debt collection.

Major bills whilst on a DMP?
Published (2009-12-24 18:26:00)
Re. you either repair it yourself or buy a cheap runaround. I hope i am not causing offence here. My opinion was voiced on what I would do and I hope I explained it makes a great deal of difference if you have assets. I did not advise anybody to buy anything they could not afford, indeed this forum is to help people to manage their debts, not add to them. The question was to ask for advice on paying a large bill whilst on a DMP. I gave my view...

I wrote to all my creditors on the 14th December telling them that they were getting bugger all this month, as it was Christmas. (just a small token payment, actually), Well - today is December 23rd, and as yet I have not had a single letter or phone call from any of my creditors. Maybe my creditors have thought, Yes ! let him have a good time on our money, he deserves it. I'm beginning to think that my creditors are all nice cuddly...

Yeah and next year I'm going to be a size 10 again! In the meanwhile I'm off to 'stuff my hodges' - I've made a big batch of sausage rolls and also some mince pies with buttery crisp pastry and Number One Son has sent me a bottle of whiskey! Chandjay I'm going to toast you specially for being the most INSPIRATIONAL debtor on these 'premises' and as 2010 is looking so bleak for you Where would you like us...

Barclays Cashcard Acct - Online...
Published (2009-12-18 09:43:00)
I went bankrupt in 2007, got early discharge after 6 months, I opened a Barclays Cashcard account on the day I was made bankrupt. The application form never asked if I had ever been bankrupt, so I did not mention it. At that time the account only had a cashcard but recently comes with a visa debit card and online banking, it is great, so much easier for me now, I have not had any problems at all with them

Quote: I gave up my mobile phone which has around £80 to pay off as i havent had the money to pay the contract. Recently this was refered to a collections agency who are refusing to accept offers of payment, They were quite agressive and said that they would take action against me. What action can they take...? The short answer is - very little if any. What they WILL do is harass and ...

This is an interesting question for me, as I have often wondered what I will do when my car eventually blows up and I need a new one. At the moment, if I get an unexpected bill, then I just write to my creditors explaining the situation and paying them a £2 token payment. This saves me about £300 a month ....but ... if I needed £2k for a reasonable car, how would I raise that ? I am waiting, with...

What can your creditors do? If you do not own property the short answer is not a lot If you do then they can secure the debt on your property Here's a rough 'vanilla' overview 1) Creditor must issue a default notice - if you are not paying the minimum required amount then this is a highly likely event 2) Creditor is then at liberty to apply to the county court for a judgement ordering you ...

They need to prove the debt. Request a CCA, and do everything in writing. I've had dealings with Robinson Way for a debt that belonged to a guy with the same name as me who lived two streets away. They sent out letters to both of us. I was about to request a CCA when a I checked the local phone book and found the guys number. I rang him up and he told me he also got a letter from RW and had ...

I went bankrupt in Novenber 2008 and was discharged 2009. I kept my Nationwide account throughout ( it was closed for about a day I think for online banking) but I use online banking. I do not have a debit card though which is a bit of a nuisance.

Hello simon, yes you can, to all your questions. A DMP is an informal agreement. Have you any assets? As that could matter if you reduce your payments. The creditors wont like it but if you have no assets there is very little they can do.

Thank you for posting that - this kind of information helps the others who really need the closure that bankruptcy will bring but cannot bring themselves to do it. Obviously you were exempted from the court fees as they would have been an extra £150- each - but although the bankruptcy deposit is steep it is a small price to pay to get rid of an unsustainable burden of debt. Well done and ...

You are quite right they DO need to prove the debt. I would however recommend that you check your credit references to make sure that this is not a case of identity theft - just a precaution, this is highly likely to be a case of a DCAs data-mining hopelessly mis-matching data from various sources. You should formally write to them disowning categorically this debt - there are template letters ...

There are various methods of getting defaults removed, some are clear cut in law and some rely on an element of 'giving up' by the creditors, but all have advantages and disadvantages. The first thing to remember is that an entry on a CRF is removed on the six year point of the default date, setllement date, etc, but it is six years form the date of which ever occured first, so if you have an ...
