They would have ti prove to a judge that they had tried to chase you for the debt and you had moved to avoid it etc before they would be allowed to chase an old CCJ. I think yoru best bet is to contact them and send them the statute barred letter - if they say there is a CCJ etc then deal wit it then - at least you'll know and you can stop jumping at shadows. At the end of the day they can't have what you haven't got to give....

I beleive they are within their rights to call but that you are within your rights to ask them to leave. You can specifically revoke their right to visit your property (which people sometimes do with debt collectors ) but otherwise there is 'an implied license under English common law' that they can call. Type the name, do not sign. Also put a deadline date of either 7 or 14 days from the date you post the letter, otherwise they will never reply. Just some advise: Ask for a Subject Access Request (SAR), which includes the original signed Consumer Credit Act 1974 agreement which was signed (so they claim) by your OH. If they can't provide that, then tell them to fob off as it won't be enforcable without the signed CCA agreement

If they goto court to enforce the debt via a CCJ, they would need a valid CCA.
If you have a scanner or access to one, scan in the documents sent. Blank out the personal details, uploading to a site like photobucket and post links to them on here. Im sure people can tell you if it is enforceable.
Creditors will often send out blanket replies saying that it is enforceable when it is not, ...

Thanks for explaining... it still doesn't make sense to me though as my 'recent transactions' only show £1.27's worth of clicks, yet underneath it say:

i suspect they have or know they are going to... recieved similar letter from halifax stating £15 flat fee (from £39 on my account!) for bounced dds etc, and apparently no charge at all for unplanned od........... really get the feeling we are all gonna get some great news tomorrow!! just waiting for the letters saying here is all your money :-D what happened with the credit card ones? did they ...

thomas has been found Bunny...rough night for me. I have what Snags has I think, I can't speak today! Not sure where that came from and my chest is so sore. Chloe made herself sick from coughing and coughed all night.

The bottom line is that if you have a credit product, from before April 2007, and the company or DCA has already defaulted you then it does no harm ...

that is far too scary.
Today I will be trying to find my dining room table under the pile of ironing. From the door the table looks like its wonky but I don't know if this is just because of all the ironing on it.
Facebook is playing up for me at the moment, its not been the same since they changed the feed thing.
Must not spend all day looking after animals in Farmville or playing ...
