After a lot of web searching and farting about i have discovered that EAX can be enabled using creative Alchemy. As it turns out it is an issue which is vista related. Hope this helps anyone out who was stuck like me.

I fixed this issue, I thought that I should post my solution since so many people seem to be suffering the same random crashes to desktop every 20-30 minutes or so.
