Planning permission - trees

I have heard references to queries about "Anti-social Hedges". They do exist - I got attacked by one of those things last Friday night on the way back from the pub... PochiSoldi

But how are you meant to get replacements if they only give you 70% of the money? You aren't meant to. It's intended for people who don't want to replace their jewelry and want to buy a car or pay off debts or go on a cruise or whatever. The individuals are happy because they get something they prefer and the insurers are happy because they got a discount. If you want replacements then the 4800 vouchers should cover it. If they...

It's hard to see where the ambiguity is here. I suggest you may be able to maintain them, trim them, in the normal way but you may well fall foul of the law if you do any major work to them. Has the S106 been signed? If not, can it be renegotiated if it is a problem? Or does this relate to someone else's permission.

"Of course there is no harm in negotiating but I am not sure you are entitled to full cash amounts, only replacements" But how are you meant to get replacements if they only give you 70% of the money? D.

HP agreement on faulty car
Published (2008-11-25 12:12:00)
hi car is 5 years old now, were never offered a warranty. If we were we ould have taken it up most definately because of the type of car it is. I think we were so keen to get back on the road after having our previous car stolen we didn't think straight. We spoke to the garage where we purchased it and explained the problem (awkward as hubby is very friendly with two of the guys there) they advised us to look into our agreement. they...

The loss adjuster has vaguely said that she is sure that Goldsmiths will be able to make to order. But whether they are able to or not, it will not be the ring that I lost. It won't remind me of my wedding day, it will remind me of the bulgary. So what exactly are you looking for here ? The insurance company can't get you back the actual ring you had stolen - all they can do is provide you with a replacement of the same monetary...

Many thanks Sarah. I would assume that in the particular circumstance you mention, the S106 or covenant or whatever would stipulate a height (or minimum height), in which case any High Hedge remedy could only be enforced if the height specification were firstly removed by a variation to the original permission.

How to deal with this scam?
Published (2008-11-27 17:06:00)
Simply insist on evidence that you ordered the service. If they say that you ordered by phone, ask for evidence . Refuse to discuss the matter on the phone; whatever they say, and however polite or aggressive they are, simply reply that you do not deal with such matters verbally, and all invoice queries must be in writing, then end the call. Only respond to any correspondence from them three times, and respond exactly the same way each time...

How to deal with this scam?

Afternoon I had something similar about a year ago. I matched their aggressive telephone manner and told them that I hadn't ordered anything and wasn't going to pay anything. I have never heard from them again. Its a bit late now, but the one thing that you shouldn't do is be polite to these people, they take politness as a sign that you might pay, so they will keep harassing you. This is not a legal answer because you...

It just occurs to me that, the higher paid the researching person, the less economic it is to answer questions. Choose an expensive person to answer a 'difficult' question and you could rule yourself out from answering it very simply. Q/'How much were the PM's expenses this year'? A/'It would be uneconomic to answer'

DAK a more precise definition of 'retained' in a final planning permission (e.g. in a Section 106)? If the Section 106 (or the developers grounds management plan issued in reply to a Section 106 condition) merely specifies that 'boundary trees and hedges are to be retained' but with no further specification, is it implied that the heights must be kept at the heights which existed at the ...

I bought a house in 2002 which was owned by a local authority. As part of the sale I had to accept a deed of covenant that stated if as a result of planning permission the value of the property increase that the authority would be due to be paid 75% of any increased value of the property. This excluded any permission granted as long as it remained a residential property ie the house can ...

At the beginning of this week, Mr W received a call telling him books he'd agreed to sponsor during a telephone conversation back in February of this year were ready for distribution. The cost would be £199 for 30 books distributed to a school of his choice and that payment was required within seven days of receipt of the invoice. Cue much worrying and head-scratching - Mr W couldn't...

Hello all I received a car parking ticket from "Town & City parking" yesterday. The car park allowed the first 2 hours free if you got a ticket from the machine. I arrived at 10am, got a ticket that covered me until 12 noon. I got a ticket at 10:40 stating "no valid ticket was displayed" and a £30 fine (if paid in 10 days). I have my ticket (stating 10:04 arrived, valid intil 12:04)....

I have a neighbour who for the past 2 months has employed a part time builder to work evenings and weekends performing a loft conversion in an attached property. We were victims of some criminal damage for which the perpetrator has been found guilty in court resulting in a criminal record and fines/costs. Close to where I live a new public road has been opened in the last year. Access is easy at one end and it takes you past (and with access to) a newly constructed business park. At the far end of the new road there is a T junction where it connects to an existing public road. This latter junction is in a semi-rural location and a couple of hundred metres from some residential streets....

In October 2007 I was in a car accident in which I was injured and my car written off, the other driver and his insurance company admitted full responsibility within a few days.
