No Keith, it doesn't work that way. The advertised rate is shown tax inclusive, but if the tax changes, then the charge similarly increases, they are not obliged to retain it at the 'advertised' rate. Taxation and variations of it are allowable. I have made international calls of over 70 mins before, at my previous address, when with Talk Talk... and all they did was charge me the lower rates for those. So, given there wasnt a problem earlier, I see no reason why there is one now.

I cancelled the contract in writing within the 7 days and they say they didnt recieve the letter, they obviously know we arent using the phone because they cancelled the sim from day 1. My second letter they say was recieved to late to late to cancel, yet I had another cw person saying that I could cancel it over the phone and to just take the phone back to the shop which we did and they wouldnt take it. It is unbelievable what has gone on but...

Ouch ! So Locutus has the best plan then. I had no idea that a service contract was any different to a credit agreement, in expecting to see a copy of the contract. Had they dealt with that question last spring, the matter could have been taken care of. So, I guess settling asap wont look as bad as leaving an unpaid debt. Should I write to Wescot or o2?

I forgot to add that i DID transfer my old number, now i have photos and ring tones on my old phone that i am unable to transfer onto the new one. I specifically said to the shop assistant that i didnt want to lose the pictures as they are of my grandaughter when she was born, and he said' just bluetooth them across', but i have tried that and it doesnt work, as the blackberry wont acknowledge or accept my old phones bluetooth!!!!...

If it's a business account then I'd imagine all prices are quoted as Price + VAT where VAT can be variable.
If it's a personal account where an inclusive price is quoted, then I'd suspect you are correct that the price may not be increased under the present contract unless when the contract started it was made clear that the price would increase.
However this does not put Orange in breach ...

You could reject the goods as you say you need it.
But by the looks of it, it looks like its Royal Mails fault that you haven't received it, not T-Mobile. Correct me if I'm wrong, but that quote you have is from the RM website after entering the tracking number? Generally RM don't guarentee delivery on a saturday unless extra is paid (this includes special delivery).

New contracts done instore have no real cancellation policy (only if there is no coverage in the areas where it'll be used and that needs to be acted on immediately). O2 are the only retail entity which allow 14 days instore for all purchases.
As for an upgrade there is NO get out! You accepted over the counter, and you cannot say the coverage is insufficient as you have used them in the ...

I have been with 02 since they took over from BT Cellnet must be 10 years
or more but I was mis-sold my last phone and all 02 would do is give me 1
month free as a gesture of goodwill. Once my contract is up I am leaving

You need to stop the DCA 's so you need to advise them that you are currently in dispute with BT over several issues, and to refer the matter back to their clients to resolve. 1st Welcome to CAG
It's always better to deal with the original creditor (o2). Write to westcot telling them you refuse to deal with them as you have a dispute over this with o2. Modify this letter http://www.consumeractiongroup.co.uk...-is-in-disp ute (take out the CCA stuff as it's not applicable on mobile contracts) and send it to Westcot

Firstly, let me say it's not just o2 that do this. Most internet contracts are minimum 18 months, cancel early and they'll charge for the whole contract and log the account activity on your credit file . Plusnet are the only ones I can think of that do a 1 month rolling contract with £30 set up fee.
Did your son dispute owing this amount when he moved to Oz?

My brothers girlfriends did exactly the same 3 weeks ago.
if its pay as you go try and get a replacement.
if your on a contract they will want to try and repair it 1st, if so, try and get a courtesy phone while yours is away.

I recently was in Australia & used my phone twice to check my gmail - I didn't upload or download files of any kind.
