Would you agree diddydicky that it is all subjective? I mean I have an issue where a creditor has stated that their default notice is NOT a termination of contract despite the wording appearing as you stated. But when asked for the termination notice, for a completely separate account but same creditor, they claim the default notice IS classed as a termination and their court action is valid. In other words, creditors will use whatever meaning...

Abbey Cards are run by MBNA they have sent this out possibly because this is the only thing they have for me as the card I requested the CCA for was initially a Bank of Scotland card which MBNA took over some time ago. I also requested from them a CCA for a Virgin Card but nothing has been returned for this.

no cca means not enforceable throught the courts
if they were to issue court proceedings then this would be your defense
it will trash your credit files as these are difficult to clear with no caa as the debt still exists
now welcome there is alot wrong with some of the agreements as well so thats another thing can be checked when you receive your response

So the 'agreement' sent by the bank has an address that you didn't live at at the time?
I'm not sure what effect the lack of a date will have, but if they've perhaps recently completed a blank agreement perhaps with your details and perhaps trying to pretend it's a copy of the original agreement they will be well and truly stuffed.

In my opinion you will not be able to just close the debit account without challenging the penalty charges and your reasoning behind it. I suspect if you ask to close it the creditor will refuse.

How you proceed depends on what the result is from your CCA request.

It is not quite so cut and dried as you think.
What the bank is saying is they cannot find your signed agreement, so this would prevent them from enforcing it through the courts, hence them making you such a generous offer of re-payment, but I would not beleive anything they say on the phone, so wait till they confirm it in writing.
