yes and no, the cca s78n request is usually fulfilled with the statement "This is a true copy of your executed credit agreement" any statement made by a creditor with respect to s77-79 and also i believe 102-104 is legally "binding" upon him, thus if he makes this statement about the document that he has enclosed in response to the s78 request, and it contains no prescribed terms or is otherwise not an...

Mortimer Clarke/Marlin ***WON*** The defendant totally disputes the debt and has been in dispute since 2007. Welshcake,
Without a valid cca they can't take you to court, simple as that. They must produce the document in court to secure an order against you and if there is no agreement, there is no judgement against you.
You can approach Next from a different angle to see if they can produce the document. Have a look at this thread: why you shouldnt use section 77/78 CCA 1974 if you want the ...

To take action against anyone they have to prove that you actually owe the debt and have a legally enforcable agreement, as any agreement that they might actually "find" was executed in a different country it is unenforcable in another country.

Ruthbridge can't do anything to anyone unless they go to court and persuad
a judge they have the right to collect. Everything you have been told by
Ruthbish in their letters is a load of bowlarks. The barstewards don't even
have the ability to adjust their letters to suit different circumstances.

Not too sure as am new to this myself but as far as I am aware if a debt isnt paid or acknowedged for 6 years or over than the debt becomes statue barred meaning they cant collect or ask for money. Would imagine this would apply to chraging order as would think they couldn't get one so it may just be scare tactics.
Wait around for peeps with more experience though, as like I say, i'm not an ...

If anyone does turn up (and I doubt very much that they will) then they
have less rights than your postman. Tell them to leave and if they do not
then call the police.

contrary to what many think there is no address black listing. Provided you didnt have any joint credit accounts there is no financial link between you and your friends credit file will not affect yours.
