An attorney retained for the purpose of a potential writ of habeas corpus will (I think) usually charge for the investigation into what grounds might exist to form the basis of a writ. They will not limit the possiblities to ineffective counsel which is very difficult to substantiate. I think that the fact the attorney in question has been disbarred may or may not be of importance dependiong upon the reason for his disbarment.

Sounds to me like they think he's doing something he's not supposed to. Individual cell searches are common and required on a daily basis at each unit although it's not often that they take EVERYTHING. Usually, it's an extra shirt or pants which most officers don't give cases for. I'd do as TDCJ Hand suggested though and call the warden's office several times a day until you get a warden on the phone. BUT,...

He needs to turn himself in. Period. The suggestion that he should "hide someplace else" is both stupid and insensitive. Just get it over-with.

Because TDCJ won't allow the pump I would recommend getting him into an endocrinologist asap, explain the situation and get his meds adjusted. Once he's in TDCJ he won't be able to go to appointments and would only be able to see a halfway competent doctor if he goes into the medical units.

thanks royce - this is really a complicated case - not exactly complicated, just strange - involves very possibly prosecutional misconduct, attorney misconduct, etc. - a law student with the U of U Innocence project has called both attorneys several times - neither will return her calls or agree to meet with her. Doesn't this seem strange when a defense attorney doesn't want to help a former client? when that client is serving a...

I spoke to our attorney and he told me that if the crime carries a 5 to 99 year sentence, as long as he was given no less then 5 and no more then 99, there is nothing you can do, however, if he had inadequate representation, then we can go for a "rit" something or other (its legal lingo, I can't remember the jargon he used) and he gave me the name of a couple excellent attorneys here in the area where we live to handle...

If hes that close,,and release is 2011,,he should max out ,,in Arkansas anyway if he did, then he wouldnt be on parole when he gets out..might be worth checking into though.. Good Luck......

They should have given him a confiscation form detailing exactly what they
took and why. Sorry but about the only recourse on his side would be to
file a grievance. You, however can best help him by calling the unit and
speaking to the warden (since the major wasn't any help) and keep calling
until you get the results you seek.

I don't know if they will jump up and go looking for him because of a revocation warrant. That might depend too much on work load of the PO or Sheriff's office or how those two work together for anyone to guess how it will play out.
