My X301 has slightly better specs than the UL30A and I can play TF2 at 1440x900 with low settings and get a playable
frame rate.

I'm assuming you mean it hits mid 60s during idle. Because if you're hitting mid-60s while in game you definitely wouldn't want to return it.
Anyway, sounds exactly like a powermizer problem. Use GPU-Z to monitor your GPU clocks and see if you're upclocking constantly.

Does Microsoft or Nvidia know about this or 2 craps? Hard to say. I am thankfully getting an ATI card next but I'm afraid
we're stuck with MSFT.

enter bios, you can adjust or mute the volume on the rog logo, or you can even disable it completely and have the normal startup screen,
you should be able to find the option fairly easily in the bios.
