Sorry, but the question is ill-posed and unanswerable.
That's nothing like what Cherie could have said (are you talking about the Sunday Mail or the Mail on Sunday?) nor what the
Human Rights Act says about property. Nor, I'm afraid are "your data" = "data referring to you" property belonging to you. Information can occasionally be the subject of proprietary rights, but only very rarely...

I was arrested to "prevent a potential breach of the peace", with no further action, why so little was given in terms of information. In America preventative
arrests are illigal, an offence must have been committed, so its ok to say never arrested for their purposes.

When I was arrested for possession of a controlled substance (meh, they caught me smoking a joint at 3 in the morning walking down
the road back from a mates), they finger printed me and did a swab of my mouth.
I actually asked them what would happen, not that I would refuse (what's the point...) if I did refuse to give the samples. They didn't mention the mouth swab but with regards to ...

Whcih kind of lead me to the question-

I can't speak for the legalities, but I suspect that the wall of silence is at least partly due to them not having considered this point and trying to find out where they stand..

Police have the power to use reasonable force to take samples when they are warranted, I believe. As far as I know arrest is almost unknown for speeding offences (save where they are combined with other offences such as
dangerous driving, obstruction, etc...). And arrest currently precedes any DNA sampling.
"Steal" is tendentious and inaccurate. Samples are not property.
(People ...

In Scotland, an arrest that does not lead to a conviction does not appear on an Enhanced Disclosure. I don't know about England & Wales though. _________________ Geraint .
