Best tell your guardians now. The Civil Demand needs to be paid asap. Don't pay it - your grandparents get sued in court. Target's legal fees are added to the costs. Oh....and your grandparents credit rating takes a hit. You also face: Court fines and costs. If you get Community Service or Probation - that may have costs. jeff, You are apparently far more interested into tricking people into incriminating themselves than in providing useful advice. This is a person that has not been charged with any crime and your "legal" advice is for him to turn himself in. Do you feel that everyone who has broken a law and not been caught should do the same? Any time a store wants to search your person you can say "No", and ask that they either let you leave or that they summon the police to conduct a search (if the police deem it to be properly supported). If they do summon the police they generally will have the authority to detain you for a reasonable time (which can sometimes be a pretty long time) while they wait for the police to arrive. I don't see that you followed...

Basically, if you can't do the time or face the consequences, then don't do the crime. Isn't that simple? You should'nt have done that in the first place.

Thanks a lot for helping me Pandora btw. I totally understand the LP's point of view. I have a pretrial coming up. Should I call the prosecutor directly before that? In your opinion, what's the best defense given my details? And does this sound like a good strategy to pursue... First off, you should get a consultation with a Criminal Defense lawyer. Most offer free consultations.
1: They add up the cost by full retail price, not sale/clearance prices. I don't know what California's Civil Demand guidelines are. If you were in Michigan, the minimum is $250. Yes, this is permitted by law. And if it does not get paid, you can be sued and expect to pay the stores legal...

No one can say for sure, but I would say it is most likely that they will let it drop as long as you do as requested and stay out of the store. If they intended to file charges, they probably would have done that already. At any rate, there is no benefit to the store or to the police to have you under surveillence. So, I think your feelings of guilt have you feeling paranoid on that point.

I'll let someone more knowledgable handle the other questions...
(1) I don't think there is anything saying LP have to provide their names, although it is listed in any paperwork and police reports.
(2) They do have the right to search your purse, coat, pockets, etc. Being treated rudely seems to be the norm.
(3) If you go back to any Lord and Taylor, they can have you arrested ...

It could also be considered Return Fraud...aka Retail Fraud... Misdemeanor.
