yeah, It started out that way because I was in Hawaii when the baby was born in CA. I guess the mediator said that was pretty much the way it always is. I didn't feel I needed to be alone with a 2 month old anyways. I have since moved to CA but had to move up near Sacramento because my family is here and I needed the help with arrangements to make the move as a single parent and an old company I used to work for helped me out with a job....

If you want to modify the existing support order, or seek enforcement of the order, you file a petition in the court that issued the order. You can appeal anything you want - see, for example, this case ; the issue is whether you have any chance of winning or missed the filing deadline. I have no information on the motion, or why your lawyer advised against appeal; I suspect he viewed appeal as futile.

would child support start from the request or from birth? And she stated her x took a test and tried to have my husband sign a declaration of paternity and he told her he wanted a test which as u see is leading to my question. While I agree that the Court will not enforce an agreement of non-payment (while the child is a minor) ... I know the more custody I get the more the cs will go down. What I'm worried about is the time in between moving down and increasing custody, when she can make me jump through hoops every six months (is that right for reviews?) to slowly increase my custody over a period of years while in the meantime I'm paying more than I can afford to support ...

How can you get what done?
If you wish to modify the existing support order, petition the court that issued the order to modify it.
If the mother returns to work she can pursue you for a share of child care expenses. She doesn't have to use the cheapest person out there, or a random person from craigslist.

If your support is modified retroactive to the date of your petition, such that you overpaid, you should get a credit on your account. Depending on how the court handles that, you'll most likely pay no further support until your overpayment is exhausted, or pay partial support until the overpayment is exhausted.

first a paternity test must be taken.
then if he is determined to be the father the Court can order he start paying child support - it is unlikely to be retroactive.
Unless the mother is a completely unfit parent (such as currently incarcerated for child abuse) the probability of your husband getting full custody is about 0%.
