He still has lots of time to BOTH file a police report AND sue you in civil court for the damages- up to a year for criminal action and two years for the personal injury. Since you were thrown out of the bar, odds are pretty good that he'd have decent witness statements for police and potential witnesses to the civil case. you can't pursue criminal charges against him. The DA decides who to charge based on police statement.

Being mentally ill does not constitute a "free pass" to get away with crimes. Most mentally ill people don't assault anybody. If he wishes to claim that he was responsible for his crime due to mental illness, his lawyer can bring a motion for a psychiatric examination to be reviewed by the court.

Thank you for your response Catherine I just learned that the sisters have no lawyer and filed the charge in small claims court. This makes me feel better. I am guessing they could not find a lawyer to take their case and this is a last ditch retaliation effort.

Los Angeles County, CA Why would the DA tell me that my partner would only serve 18 days out of 6 months on the 3rd of March and she is still in jail? It's going on 25 days. I followed thru with advice and contacted the DA that handled the case in court. She was very nice and pulled the file from closed records and reviewed everything with me. She was surprised my partner was "still" in county on day 16 and said orders...

Two and a half years ago. Two and a half years ago. I made a mistake his lawyer was not disbarred. The DA that prosecuted him was disbarred. just a note. It is hard for him to talk about but I ask him today about the appeal. He said he was told by the DA and the judge that she did not have to give him probation. If he appealed he would see jail time. Is it possible to get the full transcripts of a trial? There is just so much wrong to me here....

Quoting cyjeff I said that. She didn't hear. And, apparently, thought that reposting the same thing over again would make a difference. Yep. But, maybe my karma is brighter. If she doesn't want to hear it, she can hire an attorney to look into the matter. If there is a problem, the attorney can file a habeas motion.
