Quote: At what point does the literal definition of an insult win out over the slang definition? I don't see wither definition as slang. I can support either as an accepted definition but anyway, it is part of the process of the court action to make the call. Often, whatever the person that heard the term believes it to be is the definition of concern. Quote: And who makes the call? judge/jury Quote: I'd assume that is it up to the...

Well the phone he destroyed, he found. I imagine they got the phone owners name from her voice mail. They may have looked on face book (like that will stand in court) and see that his girlfriend and the owner know each other. But they have no actual relation to each other except face book. In fact they don't know each other. Plus he lives 3+ hours away from the mother he texted. Does that have any relevance at all?

Thanks so much. That makes sense. One of the breeders is also a good friend of mine who would like to take action. Since it is a website, and they are making anonymous posts, where would he start? We found the information listed with the domain name but that is about it. Can the breeder file against a website? Or anonymous postings? I will soon breed from these lines as well and I would much rather prefer that this slander isn't on the...

What Defines Slander

Why would you do this? The truth or an honest opinion is an affirmative defense to slander, but why would you get involved. You have left. You have nothing to gain by this except a bad reputation.

Yes, it seems WIERD and ICKY and I think I will just steer clear of the whole mess!

Quote: Quoting jk either it is factual or it is opinion. either one is a defense to defamation if true. Not intending to digress, just wanted a clarification... Words like 'whore' have two meanings. Either a 'lady of loose morals' or a 'prostitute'. The former is an opinion that is difficult to prove or disprove. The latter is an absolute yes/no that you can prove/disprove in court. At what point does the literal...

Medical Privacy Infringement
Published (2008-11-18 21:29:00)
State laws are going to be all over the place, primarily in relation to the posters. Somebody who intentionally posted false information, whatever the state, would be committing an act of defamation. Some states have privacy torts that might apply, either because of the nature of the disclosure or the manner in which the information was obtained. If the owner is merely providing a forum where people can post the information, there's a...

People have the right to voice negative opinions based on their dealings or knowledge of the breeders. You are not directly effected by their speech.

If what you say is your honest and supportable opinion, then even if negative he has no case for slander. Slander exists when you know or should have known that what you are saying is false.

My question involves defamation in the state of: Ohio I went on Medicaid a year and a half ago, and was assigned to a Medicaid HMO. I am in my 50's and had never been on Medicaid before. Within a few months, I had been seriously and permanently harmed by a doctor who did three unnecessary surgeries. (I was unable to sue him--long story.) I complained about him to the HMO. The HMO reported my...
