What are you talking about the insurance company "getting out of paying" - damage to somebody else's car, or injuries your son caused to the people he hit? Their "getting out" would be premised upon the terms of their policy, and would not result in criminal charges for any form of auto theft. You can put their insurance company in touch with your insurance company, and hope that everything's covered.

No agreement was signed. After we submitted our claim we refused any negotiating, and let them assess our vehicle. Once that was done we received a check in the mail that had in the memo field "total loss settlement". I wasn't until December 08 when they attempted to collect 1800 on that claim were we made aware of any other debt owed. Unless they decide to send you a letter detailing their claim, something that may or may not happen, the only way to find out what they're claiming is to ask them. You can call and ask without making any admissions of fault, although it seems pretty clear that you were at fault.

The insurance company is not a party to the lawsuit. The plaintiff sues the allegedly at-fault party, and the defendant turns the claim over to her insurance. However, insurance companies to like to see police reports for accident claims, and insurance contracts often set time limits for reporting accidents to the insurance company.

Get on the phone to your insurance company immediately and tell them everything that occurred. Not sure what they will do for you but it's a start. If your insurance company won't assist, you need to contact an attorney. It's quite possible they will sue your insurance company and you as well.

Most insurance companies won't total a vehicle unless the cost to repair it will be 51% to 70% of the vehicle's value - this varies case by case.
There is no mechanism by which you can force an insurer to call the vehicle a total loss.
