thank you very much for your help. I called the court house today and I was told that my payment was received and was being sent back to me with an uncashed check...turns out it was just dismissed because the police officers never turned in my summons to to court house. however, my boyfriend who was with me the same night and got the same ticket and sent his plea form in with a money order and his summons just got a court order in the mail...

Indeed, but if you tell a cop you drank a couple days ago he's not going to give you an mip. Regardless of a timeline, if the officer doesnt prove theres alcohol in your system he cant prove you were "in possesion" at the time he saw you. Thats how im looking at it.

My question involves criminal law for the state of: PA Criminal Code Title 18 Section 6308 Subsection a I was at a party with about 30 minors. I am 19. It was a friends birthday and wanted to go to his birthday party at his college. It was off campus and the police showed up. A couple of kids ran out the back and got caught giving the police the permission to enter the house. I did not drink nor was I given a Breathalyzer test. The fine is 150...

My question involves criminal law for the state of: Virginia So im at a huge apartment party at JMU and walk outside for a smoke with a red solo cup full of beer. Down the outdoor hallway an authoritative tone says "Hey Buddy, come here for a sec." so i walk calmly away from the voice to the other end of the hallway, not acknowledging the voice whatsoever, hop the small brick wall, drop the cup, and sprint. Cops dont even...

My question involves criminal law for the state of: Illinois I live in a college town and have manage to get caught by the police multiple times for under age drinking. I am currently 20 and have received two "Notice of Ordinance Violation" tickets. One was for under age possession of alcohol and the other was for under age consumption. Both tickets were on separate occasions. The ordinance violations say that there will not...

Similiar situation. Ticketed Sept 7, paid via mail and heard nothing until this week. Ticket dismissed, uncashed check returned to me. I guess it takes NYC courts that long to process.

My question involves criminal law for the state of: North Carolina Last night I went to a friends house, and obviously the people there had been drinking and the house had tons of beer cans everywhere, and alot of them were there from previous days because the house was given to him by his mom and hes the only occupant. But within 15 minutes of me being there the owner of the house left to the gas station and the cops ended up showing up and...

Alcohol actually stays in your system much longer than that.. the rule you state is certainly not an iron clad one... and is only typically used as a thumbnail benchmark to gauge the alcohol's influence.
ANY alcohol in your system would be illegal.
Any kid that tells a cop they drank would be confessing to a crime.

The judge won't be pulling up your record. The prosecutor will do that. Particularly if this is all in the same county, and all under the same prosecuting authority, I would expect the prosecutor to be aware of your record. That could have a significant impact on how the prosecutor treats your case and whether you're able to avid a license suspension.

By your own admission, you were drunk as a skunk. Whatever your friends tell you, I doubt the police officers were so stupid that it wasn't obvious to them.
You don't have to be arrested to be cited for a crime.

I'm not sure why you are claiming confusing about what you're charged with. You just told us that you are charged with violating 18 Pa.C.S.A. § 6308(a).

Nothing will ensure it, but you'll certainly better your situation by hiring an attorney and doing exactly as s/he tells you to do.

Basically you threw a beer party at your house for a bunch of minors and got caught? Entrapment? You mean a police informant provided the alcohol and enticed you to drink, when you otherwise would not have done so? Come on.
Your math is a bit off. If eight people consume fifteen beers, you've each had more than one beer by average.
It wouldn't hurt to consult a criminal defense lawyer.
