If it was a business debt then you cannot use the FDCPA as a possible remedy. You should still look to any state law remedies you may have. These vary greatly from state to state, but if there is a violation of state law you may be entitled to damages. I am trying to figure out if my student loan is a Private or Federal loan. Everyone I have talked to says that a cosigner is not needed for a Federal loan. Is this true? Because I was required to get a cosigner before I could get the loan. Any thoughts would be greatly appreciated.

You can't sue for what might have happened. You can only sue for actual damages and, at this point, you don't have any. You need to notify the collection agency in writing that you dispute the bill under the Fair Debt Collection Practices Act. http://www.ftc.gov/bcp/edu/pubs/cons...dit/cre18.s htm

I am being sued by AA LLC. for a credit card that I never applied for or used. I spoke with an attorney and he said I need to fight the case as though I do owe the money, but to never admit that. What is he talking about? I don't owe the money and I don't know what to do. I DO NOT have the money for an attorney. Can anyone give advice please. Thank You
