Not necessarily. However you never know what companies can include in their terms and conditions. Most would not mind as long as they are getting/have gotten paid. However some may only wish to deal with the individual who originally signed up. The best way to find out is to read your agreement. If there is no such clause then I reckon you are free to transfer to whomsoever you wish.

The template you are using is designed to be fluid perhaps... therefore if you don't need it fluid, just drop the entire background image as one into the .bg-navigation. Otherwise, the issue will be that either the containing div is too wide... If I could see the actual site, I might have more luck in helping you.
