Licenses aren't my area -what would the KL4 technology license say about commercialization? Would a competitor need to buy DSCO or could they just buy the KL4 license from the licensor. How can someone get rid of the DSCO management and board? msg 2903

It does seem that DSCO exist under a black cloud...aka FDA. I suspected that DSCO finally had it in the bag...but it never quite fell enough this last time for me to give it another try. I hope none of you guys got hurt badly. msg ' + item.replyToNumber + '

"It does seem that DSCO exist under a black cloud...aka FDA." This time I am not sure this was an FDA problem rather than a DSCO problem all along. One would think that they had already agreed in the SPA what the FDA viewed as validation of the batches Vs what was used in the trials!!! It seems to me that what the FDA wanted and what DSCO gave them were two different things and that DSCO management...

If DSCO had an SPA for this it would be mentioned front and center in the press releases. Crappi's spouting "new standard" not "they didn't honor the SPA". IMO DSCO knew they were on thin ice and never asked straight out what the exact standard was -so they continue to try and probide data and would not have to report, a long time ago, that they couldn't meet the FDA expectations. IMO opinion...

You're joking right? I was also in ENCY before the PFE buyout and your analysis is faulty. Thelin actually had significant sales in the EU and PFE actually stole the whole company cheaply by taking advantage of its cash weakness and needing to fund another PH3 trial. Thelin had little sales in EU and Canada.If it had sig sales ENCY would have been worth more.Correct about the Surfaxin tech does not have any sales BUT this is a new paradigm shift (synthetic vs animal) in the way respiratory distress would be treated.DSCO has done ALL of the heavy lifting regarding safety and efficacy trials.95% of the effort and costs are now behind the company with all that ...

You and I have the ENCY data point. PFE bought ENCY at about 2X its share price at the time. But ENCY had real sales of Thelin in the EU and Canada. DSCO has no obvious means for revenue. I doubt that it would fetch more than cash plus some value attached to the IP. msg 2899

It is possible to dream up some kind of head fake and perhaps even find Capetola and henchmen were saving family and/or friends buty aside from that, I don't see how you can explain the insider buys. It is not at all clear to me how the FDA can impose a "new standard" at this late date in the face of the SPA, but taking Cappy's words at face value, they did. Seems to me he has one of two choices: appeal or find someone to buy what is left. There ain't much.
