Visitors Visa for Brother-in-law
Published (2009-12-09 15:05:00)
Since your B-in-law is going to self sponsor his visitor visa, you need to send him an invite letter. He also should carry with him your and your wife's legal status in USA. Since he is self employed, he needs to carry tax return/balance sheets for 2/3years. If he runs the business from his own place, then, let him carry the property valuation certificate from his auditor. What the VO looks in his case is that he will return back after...

Your father is over 55 years old. Hence he is only required to fill the DS156. Your mother is less than 55 hence she also needs the DS157. She is a housewife hence she does not need the DS158. The application process has been designed well. So just trust the process, man.

Re entering in less than 2 months time without returning to home country (India) will surely raise eyebrows. She could be given a short stay if she can provide a good explanation but there is always some chance that she could be denied entry. The best strategy is to spend a few months in India and then return to US, say in May.

Your mother may want to visit...but it is up to the consulate whether she can or cannot come. Unless you can show some significant change in circumstances DO NOT apply right away and risk another rejection. Senators cannot really help or influence the process. It would be a good idea to have your in-laws/wife's parents try for a visa instead. It would be a fresh application and so there...
