Hi Kabkaba Thanks for you info. I was wondering if by keeping my passport it is a "good" sign that I may be getting a visa; as opposed to if they had returned it to me right away based on other persons in other forums.

You cannot continue working on L1B beyond your I-94 expiry (from L1B Visa) since L1B extension is not been filed. Your COS from L1B to H1B need to be approved to work on H1B.
Ask your employer to speed up the H1B approval by going for the premium process (additional $1000). That way, you will get the approval/rejection within 15 days. If approved with COS, you can continue your employment ...

I think, there is no fixed time for this processing. Please browse trough some discussions on this topic in this forum to get an approximate estimate.
BTW...may i ask what caused this to happen.

I got my H1B extension (I797) without I94. Here is the story.
My employeer had filed my H1 extension on 15th Aug but my I94 got expired on 5th Aug before filing xtension. I got my reciept & I797 with extension but not I94. COS from H1B to H4 from within U.S is not possible since you are out of status. Also, you may face issues with your H4 stamping for being out of status.
There is no such thing as bench when you are in H1B. Irrespective of whether you are productive or not, the company need to pay you. If your employer hasn't revoked your H1B petition, then you should complain to DOL and make them pay to ...

I don't understand your post to begin with. Is this a H4 renewal case? If so, your husband should have 2 I797s. One with the date ending X and another starting X+1. Carry both of them and you can travel if this is the case.
If not, explain with clarity what the issue is.

You need to understand the difference between Visa and Petition. Only the prior H1B petitions got rejected and approved in your case. The questions in DS156 and DS157 clearly asks about the visa. So, these sections need to be filled appropriately only if you have prior visa rejections.

Original I-797 or a copy of it is required.
Other supporting documents could be copy of your bank statements, your employment letter, pay stubs, marriage certificate etc.
