In every state I am aware of an agent must disclose they hold a real estate license in every real estate transaction (as well as all other disclosures required by the state). However, laws vary by jurisdiction. You should check with an attorney in your jurisdiction for advice on the laws of your state.

If the appraiser has submitted the appraisal to the FHA system, it doesn't matter how many comps or other appraisals you get, this appraised value stays with the house for 6 months for an FHA loan. If someone knows how to get an appraisal thrown out of the FHA system before the 6 months, pls let me know; it could come in handy.

Century 21 misrepresented a listing, and when it came down to the title clearing - it just didn't.  A second mortgage was "discovered".  Well, I find I'm out a couple grand for a house that I could have never bought for the listing price.  This doesn't seem right to me, but I'm not really sure what to do.  My realtor is also a Century 21 realtor, and I believe her loyalties are...

Sure you can qualify as long as you meet the other criteria. You can take a look at them  here . If your wife owns another house already or is not a first time buyer, you might not qualify for the first time buyers credit since the IRS treats married couples as a financial unit for the purposes of the credit. If that is the case, you might still qualify for the repeat buyers credit if your meet the qualifications. You can read more...

Thanks again to everyone for their responses.  In the end we accepted their asking price and got the closing money we were looking for.  The 4k wasn't worth losing the house over and the sellers had already come down from the original list price of $160k. For now, it looks like we got a deal, its really everything our family is looking for (location, size, etc).  I appreciate the advice and again thank...

Banks are not likely to accept an offer with a sale of your current home contingency.   But, it doesn't hurt to try.   I'm assuming you already have your current home on the market, if not, don't bother to try.

It doesnt matter. The seller ( in a short sale that is still the homeowner ) has the right to pick whichever buyer he wants. He signed the offer. Who put it in to the bank is irrelevant.

Why would you pay the difference? If it doesn't appraise and you are using an FHA loan, the appraisal stays w/the house for 6 months regardless of who buys it (as long as they use FHA.) Generally speaking, yes. Because it is far more likely the transaction will close (less things to go wrong). However, the seller of a property may not take a lower price in many circumstances, particularly if what they owe is very near the sale price.

Your agent is at the mercy of the LA who is at the mercy of Fannie Mae. They should clear this up b/c it doesn't matter if you buy it or someone else does, it has to be taken care of.
