Creditor put lien on house

If the creditor didn't renew the judgment for some reason -- and they would be unusually sloppy if they had your house as security and failed to do so (but it happens) -- then the lien is invalid. You can file an action to expunge the lien, which may or may not be styled as a complaint to quiet title depending what state you're in. Better make sure the judgment has expired though -- in California they last 10 years.

Super long story, but here are the higlights. Bought house, overpaid due to market at time. Bubble bursted, house lost about 60K in value, second son born with kidney disease, second income disappeared, started struggling, applied for modification before falling behind (and before banks started failing) never received a yes or a no. Wow! That's crazy. So you have to ruin yourself to get help?? I guess I can just wait another 1.5 years and try again with BOA. The fact of the matter is I can easily afford my payments now and just want to get locked into a fixed rate. I will just wait it out I guess. thank you all so mcuh. I did speak with Wells Fargo and was indeed told that the letter we received is automatically generated. It's called a "acceleration letter." We are in "loss mitigation" and they realize that, of course. They said they needed a piece of paperwork, so I faxed it over. I pray that we are fully approved for the Loan Mod. BTW, this is a HAMP. This is exactly what a relief of stay is. They can and will keep calling, this is exactly why they lifted the BK stay so that they could start collection attempts/Loss mitigation activities on your loan. Plus since it has not yet been discharged you still owe the debt.

I've got a somewhat similar situation -- different lenders, but my house has dropped about $300,000 in value and now my 3rd mortgage is hanging out in the wind with no equity. I stopped paying them over a year ago, and they sent me nasty letters for a while then went away. If they foreclose, they end up paying the auction fee and then they get nothing, so what can they do? It hasn't even been 3 months since the program was announced on April 28th. It's too early. If the trial mod was started before April 28th, it would be their bank's own program and not a Making Homes Affordable modification. More than likely a 1099 will be sent to you. It'll be out of your problems after the foreclosure and prob become a REO. I'm sure the bank will eventually sell it.

I would call the bank and let them know all the details of your plans. Also the bank will change the locks and put a lockbox when they notice it's vacant if you don't call.

I got a car 1 month after a chapter 7 BK and I know others that have gotten a car after a recent foreclousure...BTW, this is the military forum and not the foreclosure forum so you might want to have this moved there instead.
