That offpeak period still costs the ISP as much to provide service in as the peak period. Those who offer higher usage allowances or unlimited usage in an offpeak period do so on the basis that service (ie speed and latency) may well reflect that reality. It's a case of you get what you pay for really. ISPs that run their networks so as to avoid (to the best of their ability) congestion wont offer unlimited usage or higher off peak...

Is this a Netgear DG834G v1/2/3 - if so, thats possibly the issue. We've found them to be very unstable on the ADSL2+ platform and they don't appear to be able to cut it, whereas a DG834G v4 or DG834GT works perfectly, probably because it has a Broadcom chipset and not an old Texas Instruments one that's found in the v1/2/3...
